Ticketing Terms & Conditions
1 Overview
1.1 The following purchase policies are designed to ensure your satisfaction and understanding of the purchase process from NOBLE Entertainment Group. If you have any questions about the information below, please contact us. This Purchase Policy is subject to, and incorporates by this reference, the Terms of Use. Each ticket that you purchase is a license to attend a particular event, and is subject to the additional terms set forth on that ticket.
1.2 All customers attending an event or performance must hold a valid ticket for the same. Late arrivals may result in non-admittance until a suitable break in performance.
2 Fees
2.1 Tickets purchased from NOBLE Entertainment Group are typically subject to a per ticket charge and a non-refundable per order Payment Processing Fee. The per order Payment Processing Fees are calculated as a percentage of the total order value and apply where payment is made via Credit Card, Debit Cards and Gift Cards. The Payment Processing Fee includes (but is not limited to) credit and debit card fees and expenses, administration and associated infrastructure costs for providing these payment mechanisms.
3 Ticket Limits
3.1 When purchasing tickets from NOBLE Entertainment Group you are limited to a specified number of tickets for each event (also known as a "ticket limit"). This amount is included on the unique event page and is verified with every transaction. This policy is in effect to discourage unfair ticket buying practices.
3.2 We reserve the right to cancel any orders where we identify breaches of these limits, including where we know or reasonably suspect automated means have been used to purchase tickets. Use of automated means to purchase tickets is strictly prohibited.
4 Cancellation and Postponement
4.1 Occasionally, events are canceled or postponed by the promoter, team, band or venue due to weather conditions or situations affecting the staff or audience. When this occurs, NOBLE Entertainment Group makes every effort to ensure you receive a prompt refund if applicable. If an event is canceled, please contact us for information on receiving a refund.
4.2 If an event is moved or rescheduled, your tickets will automatically be transferred to the new event date. In this case NOBLE Entertainment Group does not issue refunds for tickets.
4.3 In the event that NOBLE Entertainment Group authorizes ticket refunds, they will be issued only to the original purchaser or to the original credit card used for the purchase.
4.4 Nothing in this Purchase Policy (including specifically, this clause) shall limit NOBLE Entertainment Group or a Presenter's liability for any breach of the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 (including any liability for consequential loss suffered by a consumer that cannot be excluded) or will or purport to limit any consumer's rights that cannot be limited by New Zealand Law.
5 Refunds and Exchanges
5.1 Before purchasing tickets, carefully review your event and seat selection. NOBLE Entertainment Group does not issue an exchange or refund for a lost, stolen, damaged or destroyed ticket unless (a) NOBLE Entertainment Group can identify at the venue the actual seat corresponding to the ticket for that event, or in the case of a general admission ticket, NOBLE Entertainment Group is able to identify (acting reasonably) and cancel the relevant ticket, and (b) you give NOBLE Entertainment Group a reasonable amount of notice ahead of the event that the ticket has been lost, stolen, damaged or destroyed, in which case NOBLE Entertainment Group will issue a replacement ticket. A change in personal circumstances does not entitle a ticket holder to return or exchange a ticket.
6 License; Ejection and Cancellation; No Redemption Value
6.1 Event Providers and Venues reserve the right, without refund of any amount paid, to refuse admission to, or eject, any person whose conduct management deems disorderly, who uses vulgar or abusive language or who fails to comply with either the Event Provider's rules or Venue's terms & conditions of entry. A ticket is a revocable license and breach of terms or rules will terminate your license to attend the event without refund. A ticket is not redeemable for cash.
6.2 NOBLE Entertainment Group reserves the right to add, withdraw or substitute artists provided that it does not cause a fundamental change in the characteristics of the event for which tickets are purchased; vary advertised programmes, seating arrangements and audience capacity, refuse admission with reasonable cause or to request a customer leave the venue if disrupting others. Please also see the clauses headed "Canceled Events" and "Opening Acts" for further information.
7 Recording, Transmission and Exhibition
7.1 You grant permission to utilize your image, likeness, actions and statements in any live or recorded audio, video, or photographic display or other transmission, exhibition, publication or reproduction made of, or at, the event (regardless of whether before, during or after play or performance) in any medium or context without further authorization or compensation.
7.2 Cameras, video and audio recording devices, mobile phones and pagers may not be permitted in certain venues. The Presenter may request that all pagers and mobile phones be turned off before entry.
7.3 The Presenter reserves the right to remove a ticket holder from the event without compensation for breach of any rules in this clause.
8 You Are Subject to Search
8.1 You and your belongings may be searched on entry. You consent to such searches and waive any related claims that may arise. If you elect not to consent to such searches, you may be denied entry to the event without refund or other compensation. Under certain facility rules, certain items may not be brought into the premises, including without limitation, alcohol, drugs, controlled substances, cameras, recording devices, bundles and containers.
9 Subject to Conditions of Entry
9.1 By purchasing these tickets you are subject to the standard conditions of entry which can be found visiting www.noblegroup.co.nz.
10 Email Marketing
10.1 By purchasing these tickets you opt-in to our email database. This database is used to communicate important information regarding the event via electronic direct mail. This database is also used to promote future events and experiences presented by NOBLE Entertainment Group.
Conditions of Entry
Entry to this event is based on your full agreement with these basic Conditions of Entry, which have been designed with everyone's safety and comfort in mind. Management reserves the right to refuse entry to any person, and to remove from the premises, without refund, any person who violates any of the conditions listed below. We also reserve the right to inspect any bag and/or articles of clothing via screening equipment and/or bag search checks. No ticket refunds or exchanges will be provided upon violation of any of these conditions.
CUSTOMER SAFETY

Obey instructions from our staff at all times.

You may only occupy the area and/or seat indicated on your ticket.

Do not attempt to enter a restricted area.

Climbing on barricades and crowd surfing are not permitted.

Shoes must be worn at all times.
BEHAVIOR & ETIQUETTE

Drink responsibly: Anyone intoxicated or using drugs will be removed from the building without recourse.

Use of smartphones or other devices must not cause distraction or annoyance to others.

iPads, tablets and laptops may not be used during events.

Unruly and antisocial behaviour will not be tolerated. This includes, but is not limited to, verbal/physical abuse of staff and other customers, attempting to enter a restricted area, climbing, defacing, littering, throwing objects, and blocking thoroughfares or fire exits.

Everyone is encouraged to enjoy themselves, and it is expected that people will want to stand and dance at certain points in the show, however, aisles and walkways must be clear. Standing on seats and sitting on the shoulders of others is not permitted, please be considerate of others.
PERMITTED

Personal effects such as coats and bags so long as they can be carried with you and easily stored under your seat.

You take responsibility for any permitted personal items you bring to the venue. We do our best to return lost property, but we are not liable for any loss or damage that may occur.

Phones, and other such personal devices (please see etiquette note above).

Registered Guide Dogs, mobility equipment.
PROHIBITED

Food and drink, including commercially branded and homemade.

Alcohol in any type of container.

Bottles

Gang patches or colours.
-
iPads/tablets, and laptops.

Firearms, fireworks, flares, and laser lights.

Smoking or Vaping.

Weapons of any kind, including items such as mace and tasers.

Illegal substances.
-
Musical instruments, rollerblades, skateboards, scooters, bicycles, and sporting equipment.

Marker pens, spray paint, and tagging equipment.

Signage and promotional products.
-
Animals, other than Guide Dogs.

Professional-type cameras and other video or audio recording equipment.

Steel-toed boots.
-
Selfie sticks, SLR type-cameras, and hi-res video recorders such as Go-Pros.
SECURITY
This event operates a thorough security regime and enhanced security checks are already in place. Security is monitored at all times to ensure the safety of all our guests.
Our staff are well trained and observant and they are doing their jobs to the best of their ability. Please show them the respect they deserve, as they carry out their roles
PHOTOGRAPHY
Photographs and/or video will be taken at the event
By agreeing to the conditions of entry, you also grant the event organisers full rights to use the images resulting from the photography/video filming, and any reproductions or adaptations of the images for fundraising, publicity or other purposes. This might include (but is not limited to), the right to use them in their printed and online publicity, social media, press releases and funding applications.
If you do not wish to be photographed please inform an event organiser.
SOCIAL MEDIA
Recording or live streaming the event is prohibited, unless prior permission has been given by an event organiser.
Stay home if you are unwell or if:

You have any symptoms associated with COVID-19 (e.g. fever, cough, sore throat, shortness of breath, sneezing/runny nose or loss of sense of smell)

You have COVID-19 or if you awaiting the results from being tested for COVID-19

You have been in contact with any known or suspected cases of COVID-19 in the past 14 days
-
You have returned, or been in contact with anyone else who has returned, from overseas in the past 14 days
Host Responsibility

Alcohol will not be served to anyone under 18, do not be offended if you are asked for ID.

Alcoholic beverages must not be taken in or out of the venue.

Anyone intoxicated will be removed from the premises and will not be readmitted.

Free drinking water is available throughout the venue, please ask staff if unsure of locations.

The All Night Menu is available at all times from the food truck.

Drink responsibly and pre-plan transport options.
Privacy Policy
Introduction
This policy sets out how we collect, process and hold your personal data if you visit our event ticket shop or otherwise provide personal data to us. We are NOBLE Entertainment Group of 41 Gateway Drive Whakatane 3191. We are the data controller of your personal data.
This policy affects your legal rights and obligations so please read it carefully. If you have any questions, please contact us at hello@noblegroup.co.nz.
Personal data we collect
We collect, process, store and use personal data when you book a ticket to an event including your name, address and email address together with payment information. We may also collect personal data that you give to us about other people if you register them to attend an event. You agree that you have notified any other person whose personal data that you provide to us of this privacy notice and, where necessary, obtained their consent so that we can lawfully process their personal data in accordance with this policy. All personal data that you provide to us must be true, complete and accurate. If you provide us with inaccurate or false data, and we suspect or identify fraud, we will record this. You do not need to provide us with any personal data to view our event ticket shop. However, we may still collect the information set under the Data we automatically collect section of this policy, and marketing communications in accordance with the Marketing Communications section of this policy. When you contact us by email or post, we may keep a record of the correspondence and we may also record any telephone call we have with you.
Data we automatically collect
When you visit our event ticket shop, we, or third parties on our behalf, automatically collect and store information about your device and your activities. This information could include (a) your computer or other device's unique ID number; (b) technical information about your device such as type of device, web browser or operating system; (c) your preferences and settings such as time zone and language; and (d) statistical data about your browsing actions and patterns. We collect this information using cookies in accordance with the Cookie section of this policy and we use the information we collect on an anonymous basis to improve our event ticket shop, our events and the services we provide, and for analytical and research purposes.
Marketing Communications
If you opt in to receive marketing communications from us you consent to the processing of your data to send you such communications, which may include newsletters, blog posts, surveys and information about new events. We retain a record of your consent.
You can choose to no longer receive marketing communications by contacting us at hello@noblegroup.co.nz or clicking unsubscribe from a marketing email. If you do unsubscribe to marketing communications, it may take up to 5 business days for your new preferences to take effect. We shall therefore retain your personal data in our records for marketing purposes until you notify us that you no longer wish to receive marketing emails from us.
Lawful processing of your personal data
We will use your personal data in order to comply with our contractual obligation to supply to you the tickets to an event that you have booked, including to contact you with any information relating to the event, to deliver the event to you in accordance with any requests you make and that we agree to, and to deal with any questions, comments or complaints you have in relation to the event.
We may also use your personal data for our legitimate interests, including dealing with any customer services you require, enforcing the terms of any other agreement between us, for regulatory and legal purposes (for example anti-money laundering), for audit purposes and to contact you about changes to this policy.
Who do we share your data with?
We may share your personal data with any service providers, sub-contractors and agents that we may appoint to perform functions on our behalf and in accordance with our instructions, including payment providers, event ticketing providers, email communication providers, IT service providers, accountants, auditors and lawyers. Under certain circumstances we may have to disclose your personal data under applicable laws and/or regulations, for example, as part of anti-money laundering processes or protect a third party's rights, property, or safety.
We may also share your personal data in connection with, or during negotiations of, any merger, sale of assets, consolidation or restructuring, financing, or acquisition of all or a portion of our business by or into another company.
Where we hold and process your personal data
Some or all of your personal data may be stored or transferred outside of New Zealand (NZ) for any reason, including for example, if our email server is located in a country outside of NZ or if any of our service providers or their servers are based outside of NZ. We shall only transfer your personal data to organisations that have provided adequate safeguards in respect of your personal data.
Cookies
A cookie is a small text file containing a unique identification number that is transferred (through your browser) from a website to the hard drive of your computer. The cookie identifies your browser but will not let a website know any personal data about you, such as your name and/or address. These files are then used by websites to identify when users revisit that website.
Our event ticket shop uses cookies so that we can recognise you when you return and personalise your settings and preferences. Most browsers are initially set up to accept cookies. You can change your browser settings either to notify you when you have received a cookie, or to refuse to accept cookies. Please note that our event ticket shop may not operate efficiently if you refuse to accept cookies.
We also use Google Analytics to monitor how the event ticket shop is used. Google Analytics collects information anonymously and generates reports detailing information such as the number of visits to the event ticket shop, where visitors generally came from, how long they stayed on the event ticket shop, and which pages they visited. Google Analytics places several persistent cookies on your computer's hard drive. These do not collect any personal data. If you do not agree to this you can disable persistent cookies in your browser. This will prevent Google Analytics from logging your visits.
Security
We shall process your personal data in a manner that ensures appropriate security of the personal data, including protection against unauthorised or unlawful processing and against accidental loss, destruction or damage, using appropriate technical or organisational measures. All information you provide to us is stored on our secure servers. Any payment transactions are encrypted using SSL technology.
Where we have given, or you have chosen a password, you are responsible for keeping this password confidential.
However, you acknowledge that no system can be completely secure. Therefore, although we take these steps to secure your personal data, we do not promise that your personal data will always remain completely secure.
Your rights
You have the right to obtain from us a copy of the personal data that we hold for you, and to require us to correct errors in the personal data if it is inaccurate or incomplete. You also have the right at any time to require that we delete your personal data. To exercise these rights, or any other rights you may have under applicable laws, please contact us at hello@noblegroup.co.nz.
Please note, we reserve the right to charge an administrative fee if your request is manifestly unfounded or excessive.
If you have any complaints in relation to this policy or otherwise in relation to our processing of your personal data, you should contact the UK supervisory authority: the Information Commissioner, see www.ico.org.uk.
Our event ticket shop may contain links to other sites of interest. Once you have used these links to leave our event ticket shop, you should note that we do not have any control over that other site. Therefore, we cannot be responsible for the protection and privacy of any information which you provide whilst visiting such sites and such sites are not governed by this policy. You should exercise caution and look at the privacy policy applicable to the site in question.
Retention
If you register with us, we shall retain your personal data until you close your account.
If you receive marketing communications from us, we shall retain your personal data until you opt out of receiving such communications.
If you have otherwise booked a ticket with us or contacted us with a question or comment, we shall retain your personal data for 6 months following such contact to respond to any further queries you might have.
General
If any provision of this policy is held by a court of competent jurisdiction to be invalid or unenforceable, then such provision shall be construed, as nearly as possible, to reflect the intentions of the parties and all other provisions shall remain in full force and effect.
This policy shall be governed by and construed in accordance with the law of England and Wales, and you agree to submit to the exclusive jurisdiction of the English Courts.
We may change the terms of this policy from time to time. You are responsible for regularly reviewing this policy so that you are aware of any changes to it. If you continue to use our event ticket shop after the time we state the changes will take effect, you will have accepted the changes.
